Terms of Service

1. Acceptance and Scope of Agreement
These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Pixlush Inc. ("Pixlush", "we", "us", or "our"), concerning your access to and use of the `https://pixlush.com` website as well as any other media form, media channel, or mobile website related, linked, or otherwise connected thereto (collectively, the "Site").
You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
2. Nature of Service: Browser-Based Execution
Pixlush provides a suite of digital utility tools (including image compression, PDF manipulation, and format conversion). It is critical to understand the technological nature of our service:
- Client-Side Processing: For all standard utility tools, Pixlush provides the WebAssembly and JavaScript codebase to your browser, but the actual execution of the code and manipulation of the file occurs locally on your hardware (your CPU and RAM).
- No Server Uploads: Because the processing happens locally, your files are never transmitted to, stored on, or backed up by Pixlush servers.
- Hardware Dependency: The speed, quality, and success of the file processing are entirely dependent on the capabilities of your local device (available RAM, CPU speed, and browser version).
3. Limitation of Liability and Data Loss
Because Pixlush acts solely as a provider of client-side executable scripts and does not host or process your data on our servers, we explicitly disclaim all liability for data loss, hardware failure, or business interruption.
By using our tools, you acknowledge and agree that:
- Browser Crashes: Processing extremely large files (e.g., massive PDFs or 4K videos) may exceed your device's available memory, causing your web browser to crash. Pixlush is not liable for any unsaved work lost during a browser crash.
- File Corruption: While our algorithms are rigorously tested, edge-case bugs may result in corrupted output files. You must always maintain a backup of your original files. Pixlush is not responsible for the loss or corruption of your original data.
- "As Is" Provision: The site is provided on an "as-is" and "as-available" basis. We disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
4. Acceptable Use Policy
While your files never leave your device during standard processing, you agree not to use the Pixlush interface to interact with, process, or generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
Furthermore, you agree not to:
- Attempt to reverse-engineer, decompile, or extract the proprietary WebAssembly binaries or JavaScript source code provided by the Site.
- Use automated scripts, bots, or scrapers to access the Site or rapidly interact with the tools in a way that places an unreasonable load on our server infrastructure (which hosts the UI).
- Use the Site as part of any effort to compete with us or otherwise use the Site and/or the Content for any revenue-generating endeavor or commercial enterprise without a commercial license.
5. Intellectual Property Rights
Your Content: We claim no intellectual property rights over the files you process using our tools. Because the files are processed locally, your copyright remains exactly as it was prior to using the tool.
AI Generated Content: For images generated using our server-side AI Image Generator, you are granted a non-exclusive, worldwide, royalty-free license to use, reproduce, and display the generated images for both commercial and non-commercial purposes, subject to the Acceptable Use Policy. We do not claim copyright over the generated output.
Our Content: Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
6. Dispute Resolution
These Terms shall be governed by and defined following the laws of the State of Delaware, United States. Pixlush Inc. and yourself irrevocably consent that the courts of Delaware shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
